FAMILY OR WELFARE REPORTS

In disputes concerning children before the Family Court, parties often seek the assistance of an experienced Social Worker, Psychologist or Psychiatrist to prepare reports concerning the children and parties to assist the Court in making a proper determination in the child's best interest.

The Court can usually make an Order requiring the preparation of such reports through the internal Court processes, but more likely, parties agree privately to fund the preparation of a private Social Worker/Psychologist/Psychiatrist report in Court proceedings.

We will advise you specifically as to which of these reports we would recommend be obtained in your particular case, having regard to the circumstances of your case.

Family Reports prepared by Social Workers are usually of assistance to the Court in determining the issues of residency and contact where some or all of the following factors exist:

The attachments of the children to each parent need to be properly examined by the Court;

The maturity and attitude of each parent to the responsibilities of parenthood and their ability to parent needs to be examined;

Each parents ability to provide appropriate emotional, social and intellectual care for the children needs to be examined;

The children have wishes and they are of an age where such wishes should be considered by an expert;

Other issues concerning the family dynamics need to be examined by an expert;

Other issues such as family violence and abuse are prevalent.
