Brett Hartley is nationally recognised as a leading expert in Family Law complex property matters and valuation of property. Brett has been a contributing author to CCH's "Australian Family Law & Practice". Brett authored part of the "Property Settlement" section and the "Valuation of Property & Business" section. This text is considered to be the most comprehensive reference on family law issues currently available in Australia. In 2007 Sarah also became a contributing editor to CCHs ‘Australian Family Law & Practice' when she reviewed the sections ‘Family Law and Bankruptcy' as well as ‘Family Law and Debt'. In addition to this, in July 2007, Sarah's expertise and experience in Family Law led CCH to approach her to become one of only a handful of Family Law representatives in Australia to write headnotes for new cases which occur in the Full Court of the Family Court. These headnotes are read by people throughout the industry, Australia wide.

Australian Family Lawyer is the pre-eminent family law publication for practitioners published by the Family Law Section of the Family Law Council of Australia. Sarah Minnery's article is currently the only published work on the constitutional validity of Part VIIIAA in relation to the joining of third parties to proceedings. Whilst there was great debate and criticism when this legislation was enacted because of its far reaching consequences for family members of separating couples as well as financial institutions, trustees of discretionary trusts and people with interests in entities also owned by married separating couples, this paper is the only one available to date which actually explores the issue of constitutional validity in detail.




Brett Hartley is recognised nationally as a leading expert on the Superannuation Splitting Laws. In January 2003, Brett was invited by the Securities Institute of Australia to join their Industry Reference Group to prepare and oversee the development of the Superannuation Module for their new Advance Diploma in Financial Services (Financial Planning). Brett was responsible for writing the module section dealing with the Family Law angle of Superannuation. Brett is also responsible for scoping and preparing assessment items and providing ongoing support and direction to the Securities Institute of Australia on this subject. In September 2004, Brett authored the Update for the Superannuation in Family Law Module.

The Securities Institute is the professional body that represents the securities and financial services industry. The Securities Institute of Australia offers post-graduate and open-entry educational programmes relevant to the financial and securities sector.




Joe Healy's superior ability to manage complex property settlements is well recognised. Joe Healy authored a paper for the Queensland Law Society Family Law Intensive Seminar in May 2004. The paper dealt with how the power of the Court to vary or set aside property orders pursuant to Section 79A is highly discretionary. Sub-Section 1 sets out four separate grounds upon which a property order may be set aside or varied. There has been a miscarriage of justice by reason of fraud, duress, suppression of evidence, the giving of false evidence or any other circumstance; s79A (1) (a); This paper focuses only on Section 79A(1)(a) - Miscarriage of Justice.




Sarah Minnery's expertise in Alternate Dispute Resolution (ADR) is well recognised. Sarah completed her Masters in Law specialising in Litigation and Dispute Resolution in 2007. Sarah has had a major article published in the July 2004 Issue of the Queensland Law Society members' publication, Proctor on ADR.

Proctor is recognised as the voice of authority in Queensland legal publishing. Proctor has earned a reputation as a credible and reliable source of information for, and on, the profession.



In November 2002 Brett Hartley authored an article for Financial Planning publication titled "For Richer for Poorer". In the article Brett examines what Financial Advisers need to know about the financial consequences of marital separation. Financial Planning is the official publication of the Financial Planning Association.

In 2001, Legal Profiles was the definitive client's guide to Australia's leading law firms, their practices and their fields of expertise. The publication was based on the most extensive research ever undertaken on the Australian market for legal services. This review was based on Legal Profiles last survey of the Family Law market, which was conducted 2000 - 2001.

Brett Hartley was also invited to be a contributing author to Legal Profiles Publication, authoring the Introduction to the Family Law area of the 2000/01 edition of Legal Profiles.




Brett Hartley is recognised nationally as a leading expert on the Superannuation Splitting Laws. In 2000, Brett Hartley authored an article for Investor Advisor, now know as Investor Weekly. The title of the article was "New laws bind couples to pre-nups". The article outlined the implications of the new laws making pre-nuptial agreements binding for the first time in Australia ."

In the September 2000 edition of the Family Law Practitioner's Association Newsletter, Brett Hartley's article on “Family Law and Policy - Binding Financial Agreements, An Overview" was published. Brett's timely article was presented as the major article in this Newsletter, circulated only to other members of the Family Law Practitioner's Association in Queensland.
