YOUR DAY IN COURT - DIVORCE HEARING

If there are no children under the age of 18, it is more than likely that there will be no necessity for you or your partner to attend at Court.

If however a Court appearance is necessary, we will either meet you at Court on the day of your hearing or travel with you to Court from our office.

"What happens in Court on the day?"

A Federal Magistrate of the Federal Magistrates Court will hear your Application.

You will come into Court with us and sit next to us at the Bar Table.

You will not be required to give evidence or say anything to the Federal Magistrate. We will speak on your behalf.

On rare occasions, there may be a need for you to give evidence, but if that is the case we will advise you and discuss this with you prior to the Court hearing.

The Federal Magistrate then reads the documents that you have filed in Court and may ask us some straight forward questions about your matter (for example, the Federal Magistrate may ask as to whether the children are still receiving child support from your partner, etc).

If the Federal Magistrate is satisfied that your Application is in order, then he/she will grant your Application and announce a dissolution of your marriage.

The Court appearance is very straightforward and simple and will take only about ten (10) minutes.
