Commercial Family Law

Commercial Family Law is the impact and importance that Family Law has in many commercial and financial areas in the accountancy, financial planning and legal environments.  The purpose of our commercial family law section is to keep our professional financial colleagues well informed and up to date in key areas where separation can have substantial financial implications for their clients.

At Hartley Healy we specialise only in family law and over the years we have discovered there are many areas of financial practice and law that are impacted on by the separation of spouses.  We are not specialists in tax or Estate planning, nor are we specialist financial advisors or accountants.  However, as specialist family lawyers, it is important that we know something about all of the areas that potentially affect our clients when delivering family law advice.

Likewise, we have come to understand that it is equally important for our colleagues to also have some knowledge of the impact that family law has upon their area of practice so they can improve their own services and advices to clients.

The purpose of our commercial family law service is to assist our colleagues and clients in recognising the potential traps and problem areas that may arise upon separation.  Our commercial family law initiative therefore provides educational tools to enable our colleagues to properly advise and educate their clients about the impact of family law in various different financial areas.

On this page, you will find copies of our commercial family law bulletins that are published regularly throughout the year on topical issues regarding the interaction of family law and other financial matters.  These bulletins provide useful information to clients, but also importantly to our other colleagues and professional advisors.

Further, we conduct seminars from time to time on relevant issues concerning commercial family law.

There are many topics that we deal with in our commercial family law service and some of these concern the following:-

  • Superannuation in family law;
  • Capital Gains Tax in family law;
  • The treatment of Trusts by the Family Law Court;
  • The family company and separation;
  • Death after separation;
  • Commercial commonsense – alternatives to litigation;
  • Income Tax and separation;
  • Bankruptcy in family law;
  • The treatment of inheritances in family law property settlements.

The above is a small sample of the many different areas covered in commercial family law.
