CHILD MAINTENANCE - YOUR RIGHTS ON SEPARATION

After separation, the parent with whom the children continue to live with is entitled to receive child maintenance from the other parent. |

This right is not automatic. The parent with the children must lodge an Application with the Child Support Agency (through the Social Security Department). |

The assessment and collection of Child Maintenance is an administrative function handled by the Australian Government. |
|
Once an Application for Child Maintenance is lodged, the Child Support Agency will make an assessment and a notice will issue to both parents informing them of the amount of maintenance to be paid each month. |

In most circumstances, the maintenance payments will be collected directly from the wages of the person required to pay maintenance. |
