CHILD MAINTENANCE - YOUR RIGHTS ON SEPARATION

After separation, the parent with whom the children continue to live with is entitled to receive child maintenance from the other parent.

This right is not automatic. The parent with the children must lodge an Application with the Child Support Agency (through the Social Security Department).

The assessment and collection of Child Maintenance is an administrative function handled by the Australian Government.

Once an Application for Child Maintenance is lodged, the Child Support Agency will make an assessment and a notice will issue to both parents informing them of the amount of maintenance to be paid each month.

In most circumstances, the maintenance payments will be collected directly from the wages of the person required to pay maintenance.
